Sale of Residential Property
We will be happy to advise and guide you in the following areas about your house sale: -
- whether or not you should sell your property before the purchase of an alternative property;
- the choice of Estate Agents for the marketing of your property;
- how to deal with viewers and, in particular, how to deal with any viewers who try to negotiate the price with you;
- how to deal with Surveyors when they survey your property;
- how to respond to any offer that is received with a time limit for acceptance. We will, if you wish, conduct any negotiation with the Purchaser’s solicitor on your behalf to try and make sure that the property is sold at the best price;
- we will negotiate the concluding of the missives or sale contract on your behalf. You will receive copies of all parts of the missive contract and we will keep you advised about the conclusion of the missive contract;
- we will get your titles from your lender along with a note of the balance needed to redeem your loan;
- we will advise you about any documents that will be needed relating to changes to your property which have been carried out by you or any previous proprietor at the property. If these documents are not available we will advise you how copies or duplicates can be ordered and will get these on your behalf if you wish us to do so;
- we will help you in ensuring that you have all the necessary Timber Guarantee documents relating to any previous timber repairs to the property. If these documents are not available, we will advise you where copies or duplicates can be ordered and will get these on your behalf if you wish us to do so;
- we will, if suitable, arrange a bridging loan on your behalf, whether the funds are needed from your sale to fund a purchase or for any other purpose. On the other hand, we can help you in trying to arrange a bridging loan with your own Bank;
- we will deal with all aspects of the conveyancing relating to the sale, including: revising all deeds on your behalf, responding to all title observations by the Purchaser, procuring all Local Authority and Land or Sasine Registry Searches, both personal and property, and the preparation of the discharge documents for the repayment of your existing loan;
- we will arrange apportionment of any common charges with any Factor of the property;
- we will inform the Local Authority about the change of ownership so that Council Tax can be apportioned properly;
- we will arrange for the repayment of your loan to your lender;
- we will pay the Estate Agent or factor accounts from the sale proceeds, assuming there are enough funds;
- we will arrange for registration of the Discharge of any existing Security over the property;
- we will arrange a convenient time and place with you for the hand over of the keys at settlement;
- we will send you a detailed statement relating to all financial aspects of the sale as possible after settlement.
