Purchase of Residential Property
We will be happy to advise and guide you in the following areas relating to the purchase of your house: -
- the funding of your purchase;
- the question of whether or not you should buy first or sell first, if you already own a property;
- the most suitable type of Survey to instruct, and the choice of the surveyor;
- the instruction of the Survey and the receipt and interpretation of the Survey Report;
- the need to instruct any specialist reports advised by the Surveyor, for instance timber guarantees or potential structural problems;
- the timing for your offer, in particular whether it would be best to make an offer subject to the survey;
- if you are in a position to negotiate the price with the Seller, we will advise you about the negotiation, or if you wish us to do so conduct the negotiation on your behalf;
- if a closing date is fixed for the property, we will advise you on what price to offer, taking into account the number of competing bids;
- we will negotiate the missives, or purchase contract, on your behalf. You will receive copies of all of the contractual stages of the missive and we will keep you advised on progress about the conclusion of the contract;
- we will examine the title on your behalf and give you details of the title and in particular title conditions;
- we will raise all title observations with the seller’s solicitors and make sure that you receive a valid title to the property which you are purchasing;
- we will complete the loan documents relating to your Bank or Building Society loan and will advise you on any aspect of the loan which needs explanation;
- we will, if you complete first, arrange a bridging loan on your behalf or help you in trying to arrange a bridging loan with your own Bank;
- we will advise you on the level of funds needed to conclude the transaction, including any Stamp Duty and registration dues. We will also arrange for the drawdown of funds from your lender;
- we will co-ordinate settlement to make sure that you know where and when the keys can be collected;
- after settlement we will arrange for the title in your favour and any security documents in favour of your lender to be recorded or registered in the proper Sasine or Land Register;
- we will send you a full statement relating to all financial aspects of the transaction as soon as possible after settlement;
- after the Keeper at the Land Registry has returned your title documents we will send you a copy of your Land Certificate, if the subjects are registered in the Land Register, and send the rest of the documents to your lender.
