Question 3

How can I make sure that assets which I give to my daughter now will not finish up with her husband should they divorce at some point in the future?

Sadly, marital breakdown is becoming more common in modern life. Many families want to make sure that errant spouses have no claims on family assets and they do not wish to rely on the divorce and separation laws to achieve this. In the absence of a pre-marriage contract, the best way to make sure that family assets stay within the family, in spite of a matrimonial breakdown, is the setting up of a simple and straightforward Family Trust. This can make sure that family members can always receive income and capital from the Trust, without spouses of the family having any claim at all on the relevant assets.
